<p><strong><span style="text-decoration: underline;">Breaking News!</span></strong><strong><span style="text-decoration: underline;"><br />
</span></strong><strong>Revised Listing Agreement Now Available on zipForm®</strong></p>
<p>GLVAR&#8217;s listing agreement has been updated with several clauses to address current legal issues and seller&#8217;s rights. The major changes include:</p>
<ul>
<li>The compensation section is broken out to clearly delineate commission earned in a sale or a lease, and to break out percentage commission and flat-fee commission. This change comports with a letter from HUD to NAR clarifying how brokerage fees are to be disclosed under RESPA.</li>
<li>To assist agents in entering the listing, new spaces are provided for the seller to give information about the Common Interest Communities which may affect the property, the amount of the dues, and whether the dues are current.</li>
<li>SID/LID information is requested in a new section which also provides the web address to look up the information.</li>
<li>The seller opt-out provisions required by the Department of Justice since 2009 are now incorporated into the body of the agreement; no separate page or addendum is needed if using the GLVAR listing agreement. (Brokerages that use their own in-house form must still provide the seller with the opt-outs. The separate addendum will remain in the zipForm® library for this purpose.)</li>
<li>A new section requires that the sellers disclose the status of their mortgage (if it&#8217;s in default or not) and requires them to alert the broker if the mortgage goes into default.</li>
<li>Electronic/digital signatures are expressly agreed to and allowed.</li>
</ul>
<p>These changes were made to the ER and EA listing agreements, as well as the unimproved land listing agreements (both ER and EA) as applicable. <hr size="3" /><strong>Short Sale Addendum Revised</strong></p>
<p>As REALTORS® continue to use and comment on the Short Sale Addendum, the Forms Committee will continue to revise and refine this form to keep it up-to-date and practical.</p>
<p>The most recent changes to the form include:</p>
<ul>
<li>A beefed-up explanation about the possible conditions that may be included in a lender approval;</li>
<li>A reference to the lender approval form to facilitate the parties&#8217; acceptance or rejection of the approval terms;</li>
<li>A clarification of timelines, and that escrow is opened and earnest money is deposited as stated in the purchase agreement;</li>
<li>The evisceration of the infamous &#8220;Paragraph 6&#8243; which now merely states that the seller may accept other offers as backup offers.</li>
</ul>

</strong><strong>Shirley and her mom should be okay</strong>.  Mom broke her leg on Friday and spent a crazy weekend in the Summerlin Hospital.  Shirley is so incredibly critical to our operation and she has given selflessly over the many years.  Please be patient as we crawl through this week.  Things will get better and up to speed next week.</p>
<p><strong>Higher Commissions!</strong>  More and more listings are beginning to offer incentives on top their coops in the mls as well as builders.  DR Horton, Richmond American, Lennar are offering up to 6% on some of their quick delivery homes.  What does this mean?  Inventories are growing, absorption is slowing via fewer closings each month coupled with fewer able buyers thanks to our nation leading unemployment rate.  It is not unreasonable to believe prices will further decline in the last quarter of this year.</p>
<p><strong>City Field in the MLS</strong>.  Listing agents are now required to complete the “city” field in the mls.  Many of us did not even realize there was no city field.  But now, there is one.</p>
<p><strong>Major Props!</strong>  Congrats to Anthem&#8217;s <a href="http://www.facebook.com/diane.dobson#!/profile.php?id=100000406037869&amp;ref=ts" target="_blank">Diane Dobson </a>for earning her ABR designation.  Diane adds this to her CDPE designation she earned last month.  What&#8217;s cooler?  Diane got her first remax referral this past week as well due.  Keep it going Dobson!</p>

</strong>Wish you had the $8000 tax credit still around?  How’s this for motivation…$54,000 in credits!  That’s right, a buyer who locked in their rate in April will pay up to $54,000 more to borrow their money.  Rate have dipped more than 1/2% since the expiration of the tax credit.  Another angle is a buyer can afford more house as a result of the lower rate as well.</p>
<p><strong><span style="text-decoration: underline;"><span style="color: #ff6600;">From the Company Files</span></span></strong><br />
<strong>Marilyn Mattson </strong>and <strong>Andi Ahart</strong> were omitted from the CDPE attendees from last week’s class.  We had 10 of the approximately 70 agents present in the class – of this I am very proud.  Congrats to the newest CDPEs in Las Vegas.  You’ll make the transaction that much better no matter what side you are on.<br />

Facebook, can it work?</strong>  Another referral found in the world of Facebook in the last week.  This was the most talked about and the well attended topic in the CRS Conference this week in Las Vegas.  RE/MAX has a guide on Mainstreet in the marketing/public relations tab.</p>
<p><strong>Shortsale Addendum.</strong>  We have a company short sale disclosure to be signed by EVERY seller in a short sale.  It is in the company library on ZipForms.  It is to be in your company file on the doc manager.  Please implement it immediately.  This was drawn by a short sale attorney to protect us from future action.</p>

HUD homes</strong>.  They are a huge part of our market now and some interesting changes are coming down the pike.  New 30 day owner-occupant rules for insurable properties, 5 days for non-insurable.   New website, properties coming on the market daily instead of just one day a week and more.  Saw a man who sold 4000 HUD homes today talk about his buyer agent days – pretty interesting.  Did you know $100 dollars down is available?  Learn this market – there are opportunities for paydays.  Look at the numbers through end of June.  667 houses closed, 549 listed (336 in pending), $84,000 is avg sales price, $2,080,612 in commissions have been paid.<br />

I keep finding things that are so much easier than Property Boss was. And I dont think it&#8217;s too soon to say that Echeck is a resounding success story for our office. 134 of my clients are signed up on this and so far not a single real complaint. If no one else says thank you for making the effort this year, I&#8217;ll be the first and hopefully not the last.”</em><em></em></p>

<p><strong>Quick Reminder!<br />
</strong>There will be no office meeting this July.  It is a very busy month with conferences (CRS, Mike Ferry, StarPower) and education/designation classes (<a href="http://bit.ly/9ZUHpW">CDPE</a>).  With all the choices available and many of them right here in our backyard, go get some inspiration and motivation!</p>
<p><strong>From the Opportunity Files</strong></p>
<p>Several of our company agents have renewed their farming regimens to secure listings.  AS we have talked before, this market is as “regular” as one can get.  The only thing missing is equity.  Local stats show that more than 30% of our closings are short sales.  One Anthem agent said last week in the hall “I’m going to CDPE because I can’t refer half of my business opportunities to other agents”  She is starting to farm an area again as well.</p>
<p><strong><a href="http://realestate702.com/home.asp">Dan Edgington</a></strong> (Anthem) went to the class about buying houses at the trustee sale auction.  Said the info was good and the class was packed! An advanced class maybe coming.  This was done by FATCO.  Look for future announcements for this class – this is an opportunity to play with investors and flippers.</p>
<p><strong>From the Company Files</strong></p>
<p><strong>Some very interesting statistics regarding median price</strong>.  Market-wide, the median price for Las Vegas detached houses in June this year was the same number as last.  Our company Average Joe Index shows some interesting trend lines for 1500, 2000, and 2500 square foot houses.  <strong><a href="http://bit.ly/dzKiVL">Go here to download</a></strong> the report.  Use it to communicate with your clients, on listing appointments, or buyer consultants.</p>
<p>Look for some additional stats coming this week as we look at closings by term, inventory, and supply numbers.  FYI, for the first time in more than 2 years, we have consecutive weeks of increasing inventory numbers.</p>

</span></span></strong><strong>Smartphone? </strong> Apple’s 4<sup>th</sup> generation iPhone sold 1.7 million units over the 3 day weekend – there is a problem with the antenna in the bezel of the phone – look for a bug fix.  Alternatively, Verizon launches a new Droid based phone called the X by Motorola on July 15 that will also work as a mobile hotspot for wi-fi computing.  Droid based phones are the fastest selling mobile phone platform today.  I’ve ordered one for myself.</p>

<p>Our office meeting for this month will be on the <strong>16<sup>th</sup> of June @ the Enterprise Library</strong>.  We will have an update on legislative rumblings, new opportunities in the market, and a panel of experienced short sale agents detailing their qualification processes of sellers and what they do to ensure a commission check is their reward.  By the way, we are looking for suggestions for new meeting places – let us know.</p>
<p><strong>Again, CDPE is coming to Las Vegas in July</strong>.  <a href="http://www.cdpe.com/go?p=DPIBSPL&amp;w=DPIBSPL">Click here for a short video</a>.  Our panel will be CDPE certified agents.  A few of you have brought up the idea the that word “expert” in the designation is justification for not pursuing the most widely recognized certification for this segment of our distressed market due to liability reasons.  You do not need to refer to yourself as an expert – a “specialist” is how I would promote.  It is a designation not a title – <strong>and it is the 2<sup>nd</sup> most searched designation in the RE/MAX referral network after CRS.</strong></p>
<p>Speaking of CRS – <a href="http://www.proact2010.com/">go here</a> and get your classes lined up with a 6 day blitz of education right in our back yard, ProAct. <strong>CRS designees earn more than $40K above the average RE/MAX agent</strong>.  Part of that is due to the referral benefits in our network.</p>

<p>May statistics are starting to drip out – <strong>inventory is up</strong>, pendings are flat, supply will ultimately grow as we come to the second half of the year.  Think differently?  Let me know, I would like to hear your thoughts.</p>
